Abstract
The objective of the research was to determine how the competition of the third party with preferred payment influences the protection of the mortgage creditor; applying the quantitative method, with a sample of 74 mortgage creditors, specialist lawyers and magistrates in civil and commercial law, and the instrument was the questionnaire; It has been found that 89.2% of respondents have established that the competence of the third party with preferential payment allows respect for the protection of the mortgage creditor, 62.2% that the competence of the third party with preferential payment in the coercive execution procedure produces positive effects when the Judge grants the mortgage creditor the appropriate protection mechanism, 87.8% that the competence of the third party with preferential payment when the preferred third party is a creditor with a mortgage guarantee favors respect for the right of defense and 52.7% that the modification of article 533 of the Civil Procedure Code that allows establishing competence when the affectation or execution is of an extrajudicial nature affects respect for the effective procedural protection of the mortgage creditor. Conclusions, it was determined that the competence of the third party with preferential payment allows the protection of the mortgage creditor.
